Core Issues
The SAT member dismissed legitimate business ventures as "chronic delusions" based solely on a diagnosis of schizoaffective disorder, in direct violation of the Equal Opportunity Act 1984 (WA) Part IVA.
The SAT violated the presumption of capacity under Section 4 of the Guardianship and Administration Act 1990, requiring Stephen to prove capacity rather than requiring evidence of incapacity.
Over $441,000 in quantified losses, including Public Trustee fees, lost business income, and missed investment opportunities. Most tragically, the death of Stephen's wife on 7 July 2024 due to the Public Trustee's refusal to release funds for medical treatment.
Stephen was silenced during the hearing, his psychologist's testimony was dismissed, and he was denied the ability to present evidence. The member told him "you're not helping yourself" when he attempted to defend himself.
